If it's on their own property, it might be legal. In fact, it should be. Using paint by giving it away is better than tossing it.

But if it was abandoned on another's property, then that's just dumping. Which is illegal.

It's on the sidewalk in front of their property. Paint is a hazardous material and they've left it out in the elements.
